7.1 Our role
Wapzio operates a technical platform that transmits communications on the instructions of its business customers. In respect of that content, Wapzio is an intermediary under section 2(1)(w) of the Information Technology Act, 2000. Wapzio does not initiate transmissions, select Recipients, or select or modify content.
7.2 Rules of use
By accessing the Services you agree not to host, display, upload, publish, transmit, store, update or share any information that is prohibited under Rule 3(1)(b) of the IT Rules, 2021, including information that: belongs to another person and to which you have no right; is obscene, paedophilic, or invasive of another's privacy; is harmful to a child; infringes intellectual property; deceives or misleads as to origin; impersonates another person; threatens the unity, integrity, defence, security or sovereignty of India, public order, or friendly relations with foreign States; or contains a software virus. 7.4 How we handle a grievance
- Acknowledgement within 24 hours of receipt, with a unique Grievance ID.
- Verification of the complainant's identity and the particulars of the complaint.
- Disposal within 15 days of receipt, with a reasoned written response.
- For a complaint concerning content that is prima facie in the nature of an offence against a person's body, or that exposes a private area, or shows full or partial nudity, or depicts a sexual act, or is impersonation including morphed images: removal or disabling of access within 24 hours of receipt of the complaint.
- Records of every grievance, action taken and the reasoned response are retained.
7.5 Content removal on legal order
On receipt of an order of a court of competent jurisdiction or a notification by an appropriate Government agency under section 79(3)(b) of the IT Act, Wapzio will remove or disable access to the material within 36 hours, and will preserve the material and associated records for 180 days or longer if directed.
7.6 Record preservation
Wapzio preserves information and associated records for at least 180 days after removal or after cancellation or withdrawal of registration, for investigative purposes, in accordance with Rules 3(1)(g) and 3(1)(h) of the IT Rules, 2021, and maintains ICT system logs for at least 180 days within India in accordance with the CERT-In Directions dated 28 April 2022.
7.7 If you are dissatisfied
You may pursue any remedy available to you under Applicable Law, including approaching the Grievance Appellate Committee constituted under Rule 3A of the IT Rules, 2021, or a court or Consumer Commission of competent jurisdiction. For personal-data grievances, you may approach the Data Protection Board of India.
